Analysis Summary of International Sale and Purchase Agreement for Liquefied Natural Gas (LNG) -- From the Buyer's Perspective

The Trend of Zhiwang Case to Guess -- Also on the Legal Issues of Anti monopoly and Compliance in Academic Literature Databases
On May 13, the official account of the State Administration of Market Supervision, Shishuoxinyu, released the news. Skyrocketing civil compensation may be detrimental to the construction of independent director system in listed companies in china
Recently, five independent directors of Kangmei Pharmaceutical were sentenced to 369 million yuan of joint and several civil liability by the Guangzhou Intermediate Court of Justice, triggering widespread social repercussions. The mainstream view seems to be that vase directors deserve their crimes, and severe punishment is conducive to making an example of others; "Heavenly priced compensation is not enough to regret, and even to celebrate.". The viewpoint of this article is that under the current system design framework, requiring independent directors to bear sky-high civil compensation may be detrimental to the construction of the independent director system of listed companies in China. On January 18,2016,the head of the Department of Treaty and Law of the Ministry of Commerce issued a statement announcing that China had won the final victory in the implementation of the anti-dumping measures case against EU fasteners(Case No.DS397).This 100-page appellate body report supports almost all of China's appeals and refutes the EU's appeals,which is a complete victory for China.At this point,the WTO dispute procedure on fasteners between China and the EU,which began in 2009,has basically come to an end.

The Indian Ministry of Commerce and Industry recently issued a final ruling on India's anti-dumping investigation against metronidazole against China. The announcement of no harm closure and termination of anti-dumping investigations ultimately resulted in a comprehensive victory for Chinese enterprises. In the series of anti-dumping final rulings released by the Indian government from the end of September to early October, the metronidazole case represented by Gaopeng Law Firm was almost the only case that was ruled harmless and terminated. A team composed of senior partner lawyer Jiang Liyong, as well as lawyers Sun Zhen and Zhang Bo, provided legal services for the company in response to the Indian anti-dumping investigation.

Recently,the Ministry of Commerce of China issued a final decision on anti-dumping cases against stainless steel billets and hot rolled stainless steel plates/coils imported from the European Union,Japan,South Korea,and Indonesia.Gaopeng represented POSCO,a South Korean steel company,and ultimately obtained a satisfactory result of the price commitment.It is also the only enterprise to obtain a price commitment in this anti-dumping investigation.Although many companies have submitted price commitment applications,the Ministry of Commerce of China has only accepted applications from customers represented by Gaopeng.

Win in America! Gaopeng Represented Chinese Steel Enterprises for the First Time in Responding to the US 337 Investigation, Fully Winning the Case
On March 19,2018,the United States International Trade Commission(ITC)issued an announcement,deciding to terminate the antitrust investigation of the carbon steel and alloy steel 337 case.ITC ruled that the plaintiff had to prove that it had suffered damage due to the defendant's monopolistic behavior,and because the plaintiff could not prove it,it was not eligible for litigation.So far,after two years,China has won all three lawsuits in the Steel 337 case,namely,antitrust,theft of trade secrets,and fictitious origin.The rarity of legal charges,the high amount of money involved,the wide range of products,and the number of accused steel companies in this investigation are unprecedented in the 337 US investigation cases encountered in China.This case will have a significant impact as a 337 precedent.In the future,the United States will face great difficulties if it wants to file antitrust charges under the 337 procedure.In the current situation where the United States is trying to jointly block Chinese steel through a 232 investigation with other countries,this time,Chinese enterprises have won a comprehensive victory in the domestic legal proceedings in the United States,which is heartening.
