On the Jurisdiction of Disputes over Corporate Capital Reduction and Shareholders' Liability for Damage to the Interests of Corporate Creditors

Which court should have jurisdiction over shareholder defect capital reduction?
Whether a shareholder's defective reduction of capital belongs to an infringement dispute of shareholder withdrawal of capital or a company's reduction of capital dispute directly affects which court should jurisdiction the dispute. In practice, there are many disputes over such jurisdiction, and court judgments are also different. The author recently handled a case of capital reduction dispute, focusing on the analysis of the cause of the case, first determining the cause of the case, and then determining the jurisdiction court, in order to obtain the support of the court. Here is a brief description for my colleagues.

The Crime and Non crime of Zhang Meng's Commercial Bribery Arrested by Tencent in Anti Corruption
On January 25, 2022, the Tencent Anti Fraud Investigation Department released the "Tencent Group Anti Fraud Notification", stating that Zhang Meng, the leader of the PCG film and television content production department, was suspected of using his position to seek benefits for suppliers and collecting supplier benefit fees. His behavior violated the "Tencent High Voltage Line" and was dismissed. At the same time, he was transferred to the public security organ for suspected crimes. The presiding judge of this case is the Deputy Chief Justice of the Criminal Tribunal of the Wuhan Intermediate People's Court. Even he himself said that he had worked in criminal trials for half his life, and this is the first time that the sentence has been changed in this way.

Recently,in the case of a loan dispute between a large state-owned enterprise and a company or a commercial bank in Hebei Province that involved more than 110 million yuan,the Higher People's Court of Hebei Province issued a final judgment of second instance,rejecting the appeal of a company in Hebei,and upholding the judgment of first instance on rejecting all litigation claims of a company in Hebei.The case I represented ultimately won all the cases.
