On November 30,2018,the 18th Cross-straits Economic and Trade Arbitration Symposium was successfully held by the China International Economic and Trade Arbitration Commission(hereinafter referred to as“the CIETAC”)and the Chinese Arbitration Association,Taipei(CAA)in Taichung.This symposium gathered over 100 representatives from the CIECTAC’s delegation,and law circle,business community and arbitration institutions across the straits.Lawyer Zhang Zheng,vice chairman of the Beijing Lawyers Association and the founding partner of Gaopeng&Partners,was invited to deliver a speech titled Discussion on Ethical Norms and Moral Dilemmas of Arbitrators at the symposium.

This symposium focused on the latest development of cross-straits arbitration and had three topics under discussion including“comparison and latest development of cross-straits arbitration system”,“ethical norms of cross-straits arbitrators”and“comparison of evidence system in cross-straits arbitration procedures”.Lawyer Zhang Zheng gave a speech in the topic discussion of“ethical norms of cross-straits arbitrators”hosted by Lawyer Liu Yong,partner of Beijing Yingjian Law Firm and Yeong-Chyan Wu,president of Shin Hsin University.Based on his experience in hearing cases as an arbitrator of over 20 arbitration institutions,Lawyer Zhang pointed out that although the arbitration system was imported from the West,the cross-straits arbitrators rooted in Chinese traditional culture had common ethical norm basic and encountered the same moral dilemmas.Later,Lawyer Zhang interpreted the moral dilemmas faced by the arbitrators in hearing cases from four aspects such as“contempt from the heart”,“temptation from money”,“trouble from the ways of the world”and“pressure from power”.Finally,quoting a saying that an educated man should be resolute and broad-minded,for he has undertaken a heavy responsibility and undergone a long course from Taibo Chapter of Analects of Confucius,he proposed that there is a long way to go for the in-depth cooperation and integrated development of cross-straits arbitration and the institutionalized cooperation model created by the CIETAC and the CAA since 2001 is an enabling platform.Besides,he also expressed his wish for the future development of cross-straits arbitration.Lawyer Zhang’s speech was highly recognized and echoed by the participating the experts.The symposium further promoted the communication and exchanges of cross-straits arbitration field and played a positive role in protecting the legitimate rights and interests of cross-straits parties in accordance with the law.

During his stay in Taiwan,Lawyer Zhang also made presence at the 2018 Cross-straits Arbitrator Training jointly held by the CIETAC and the CAA on November 29.
